A Pennsylvania man is behind bars, accused of intentionally starting the barn fire at Tioga Downs that killed more than two dozen racehorses.

New York State Police Bureau of Criminal Investigation arrested Boyd H. Fenton, 32, of Athens, PA. Fenton is facing the following charges: 

  • Arson in the third degree, class “C” felony
  • Burglary in the third degree, class “D” felony
  • Criminal Mischief in the second, class “D” felony
  • Assault in the second degree, class “D” felony

Police say the fire took place at one barn and caused thousands of dollars in damages.

A Fox 40 news crew says state police K-9 units were on the scene near the barns along Bardwell Road.

Multiple fire departments in Tioga County and Pennsylvania were dispatched to the fire Thursday morning at Tioga Downs Casino in the Town of Nichols. Tioga County Dispatch received a call at 6:35 a.m. One person was treated for burns.

Tioga Downs Owner Jeff Gural issued the following statement:

‘We are deeply saddened by today’s tragedy, it was a loss no one could have imagined or expected.  It is an active investigation so we are not able to comment any further at this time. We would like to express our sincere gratitude for all of the first responders who rushed to our aid, we have a wonderful community and we are honored to be a part of it.’
