The trial for Senator Tom Libous is scheduled to start Monday.


Libous is facing charges of giving a false statement to an FBI agent. His son Matthew was previously sentenced to six months in federal prison after he was convicted of three counts of subscribing to false tax returns.

Libous says he is innocent of the charge.


In June U.S Attorney Preet Bharara asked a federal judge to keep Libous from mentioning his cancer diagnosis at the upcoming trial.


The prosecution calls his condition irrelevant to the charge and say its mention would only be used to gain sympathy from the jury.

Jury selection is scheduled for Monday morning at 9:30 in White Plains before U.S. District Judge Vincent Briccetti.
